Dog Training Service Contract

This Agreement (“Agreement”) is entered into on March 17, 2026 by and between the undersigned client (“Client”) and Brook’s Dog Training Academy (“BDTA” or “Trainer”).

This Agreement governs all dog training and related services provided by BDTA to the Client and shall remain in effect until terminated in writing by either party.

1. Definitions

Dog: Any canine owned, fostered, or otherwise under the care or control of the Client that participates in services provided under this Agreement.

Appointment: A scheduled training session, typically lasting 30 or 60 minutes.

Consultation Appointment: The initial meeting between Client and Trainer.

Package/Program: A group of training sessions purchased together at a flat rate.

Training Services: Includes instruction, demonstrations, coaching, recommendations, and provision of training materials.

Emergency: A serious and unforeseeable event that prevents reasonable participation in training (such as serious illness, injury, death of the Dog, serious illness/injury of Client or immediate family member, or natural disaster). Documentation may be required.

2. Dog Health & Veterinary Care

The Client represents and warrants that the Dog:

  • Is under the care of a licensed veterinarian
  • Is in good health and physically able to participate in training
  • Is current on vaccinations required by law and recommended by a veterinarian

The Client agrees to inform BDTA of any medical conditions, injuries, pain, or medication changes that may affect the Dog’s behavior or ability to train.

Proof of vaccinations may be required prior to participation in group classes, public training sessions, or events.

BDTA is not a veterinarian or veterinary behaviorist. Training recommendations do not replace professional veterinary care.

3. Disclosure of Behavior History

Client agrees to disclose any known history of aggression, biting, threatening behavior, or serious behavioral concerns involving the Dog prior to the start of training.

Failure to disclose known behavioral risks may result in immediate termination of services without refund.

4. Scope of Training Services

BDTA provides coaching and training services using science-based, force-free, and fear-free methods.

The Trainer’s role is to teach and guide the Client in how to train and manage their Dog. Training sessions are educational in nature. BDTA does not “fix” dogs, but instead provides the knowledge and coaching necessary for the Client to work successfully with their Dog.

Because every dog is a living animal with unique temperament, history, genetics, and environmental influences, specific results cannot be guaranteed.

The Client acknowledges that:

  • Training success depends heavily on consistent practice between sessions
  • The Client is responsible for following training recommendations
  • Behavior may regress if training and management are not maintained

Training packages are a commitment. There are no instant solutions or “quick fixes.”

5. Client Participation

Dog training is a collaborative process that requires the Client’s active participation.

The Client agrees to be present, attentive, and actively involved during training sessions unless otherwise agreed in writing.

If the Client chooses not to participate, is distracted, or schedules sessions during times when they cannot reasonably focus on instruction, BDTA is not responsible for how the Client chooses to use their session time or for any lack of progress resulting from limited participation.

Unless otherwise agreed in writing, the Client remains the primary handler responsible for the Dog during all training sessions.

6. Training Environment & Safety

For in-home training sessions, the Client agrees to maintain a reasonably safe and appropriate environment for training. This may include:

  • Securing other pets when necessary
  • Minimizing household distractions when possible
  • Supervising children or guests present during sessions
  • Ensuring that walkways, floors, yards, and other training areas are reasonably safe and free from hazards.

Children must be supervised by a responsible adult at all times.

BDTA reserves the right to pause, modify, or terminate any training session if the Trainer determines that continuing the session would pose a safety risk to the Trainer, Client, Dog, or others present.

7. Training Equipment

BDTA utilizes humane, force-free training methods.

Prohibited equipment and methods include, but are not limited to:

  • Shock or electronic collars
  • Prong collars
  • Choke chains
  • Ultrasonic deterrent devices
  • Any fear-based or forceful training techniques

The use of prohibited tools or methods may significantly delay or prevent training progress. BDTA is not responsible for lack of progress if such methods are used outside of training sessions.

The Client is responsible for ensuring that all equipment used during training (leashes, collars, harnesses, etc.) is properly fitted and in safe working condition unless the equipment is provided directly by BDTA.

8. Fees & Payment

Packages:

A minimum of 50% is due on or before the first session. The remaining balance is due prior to the final scheduled session.

Single Sessions:

Payment is due in full at or before the time of service.

Returned Checks:

A $50 fee will apply to any returned check.

Receipts are available upon request.

9. Non-Refundable Policy

Training packages represent a commitment of reserved training time.

For this reason, training packages are non-refundable once purchased, whether sessions are partially or fully used.

In the case of a documented Emergency, BDTA may consider a partial refund at its sole discretion. Refund requests must be submitted in writing within 7 days of the last scheduled session. BDTA’s decision regarding refunds is final.

10. Scheduling & Package Timeline

Training sessions must be used within 90 days of the first session, unless an extension is granted in writing by BDTA.

Unused sessions after this time period will be forfeited without refund.

Cancellations require 24 hours notice.

No-shows or late cancellations will be charged in full, except in legitimate Emergencies.

Sessions begin at the scheduled time. If the Client arrives late, the session will still end at the originally scheduled time.

11. Travel Policy

BDTA provides in-home training services within a standard service area.

Locations outside of this service area may be subject to a travel fee. Any applicable travel fees will be discussed with the Client prior to scheduling.

The Client is responsible for ensuring the Trainer has safe and reasonable access to the training location.

If travel conditions become unsafe (for example severe weather, road closures, or hazardous conditions), BDTA may reschedule the appointment.

12. Group Classes & Events

Dogs attending group classes or events must:

  • Be healthy and current on vaccinations
  • Be handled on a 6-foot leash with a collar or harness
  • Not use retractable leashes or aversive training equipment

BDTA reserves the right to remove any dog from a group class or event if safety is at risk.

Event fees are non-refundable once booked.

13. Termination of Services

BDTA may terminate services immediately, without refund, if:

  • The Dog presents a safety risk
  • The Client behaves in a hostile, disruptive, or unsafe manner
  • The Client fails to follow safety protocols
  • The Client violates the terms of this Agreement

The Client may request termination of services in writing at any time. Refunds will not be issued except as stated in Section 9.

14. Liability & Assumption of Risk

The Client understands that dogs are unpredictable animals and may cause injury or property damage.

The Client accepts full responsibility for the Dog’s behavior before, during, and after training services.

The Client acknowledges that participation in dog training involves inherent risks, including but not limited to bites, scratches, falls, or other injuries.

The Client agrees to release, indemnify, and hold harmless BDTA, its owners, employees, agents, and contractors from any claims, damages, injuries, losses, liabilities, or expenses (including attorney’s fees) arising out of or related to:

  • The Dog’s behavior or actions
  • The Client’s handling of the Dog
  • Participation in training services
  • Any injury or damage caused by the Dog to any person, animal, or property

15. Media Release

Client grants BDTA permission to use photos or videos of the Client and their Dog for lawful business purposes, including advertising, marketing, website content, and educational materials.

Client may opt out of this media release by providing written notice.

16. Arbitration & Governing Law

This Agreement shall be governed by the laws of the State of Florida.

Any dispute arising under this Agreement shall first be addressed through good-faith negotiation.

If the dispute cannot be resolved informally, it shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA) in Highlands County, Florida, unless the matter qualifies for resolution in small claims court.

Both parties waive the right to a jury trial.

17. Force Majeure

BDTA shall not be liable for failure to perform services due to events beyond reasonable control, including but not limited to natural disasters, severe weather, illness, government restrictions, or other unforeseen circumstances.

18. Entire Agreement

This Agreement represents the entire understanding between the parties and supersedes all prior discussions or agreements.

Any modifications must be made in writing and signed by both parties.

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Electronic Signatures

This Agreement may be executed electronically. The Client agrees that an electronic signature, digital signature, or other electronic acknowledgment shall have the same legal effect as a handwritten signature.

By signing electronically, the Client confirms that they have had the opportunity to read and review this Agreement in its entirety and agree to be legally bound by its terms.

Electronic copies of this Agreement, including those transmitted by email or through electronic signing platforms, shall be considered original and legally enforceable.
